重 要 聲 明

本公司專業人員(包括註冊營養師及營養師/膳食保健師)提供營養治療諮詢及健康飲食教育,並不從事醫療診斷或醫療處方。本公司服務不構成任何醫療建議或醫療護理,亦不能取代由醫療專業人員(包括醫生)提供的任何醫療服務。如您有任何疾病或健康疑慮,請諮詢註冊醫生。


第一條免責聲明

1.1本公司人員包括持有認可資格的註冊營養師,以及營養師/膳食保健師。不同人員的專業資格及服務範疇或有差異。本公司服務範疇為:提供個人化飲食及營養建議、講授有關食物、膳食補充劑及飲食習慣的專業知識、協助客戶了解及改善個人營養狀況。

1.2本公司人員不提供以下服務,亦不在其執業範圍內:醫療診斷(diagnosis)、醫療處方或藥物建議、任何形式的醫療治療(medical treatment)。

1.3「營養治療」(Nutritional Therapy / Medical Nutrition Therapy)為國際認可的營養師專業術語,指透過飲食及膳食補充劑干預,從營養科學角度支援整體健康管理。此術語並不代表或暗示本公司提供任何醫療診斷或醫療處方服務。

1.4若客戶目前正在接受醫療保健專業人員護理或服用處方藥物,客戶應於更改飲食習慣或開始服用任何膳食補充劑前,先與其主診醫生商討。客戶不應在未獲主診醫生批准的情況下停服任何處方藥物。

1.5本公司提供的營養諮詢服務與醫療機構服務相互獨立,並不構成醫療建議或護理。客戶應繼續接受主診醫生的定期醫療監督。

1.6在香港適用法律許可的最大範圍內,本公司對由客戶自行決定採納或不採納本公司建議而引致的任何損失、損害或後果,概不承擔責任。


第二條個人責任及責任限制

2.1客戶確認,客戶須對其本人、家庭成員及子女(如適用)在接受本公司服務期間及其後所作的一切生活及健康決定承擔全部個人責任。所有營養建議的預期成效,均以客戶充分遵循相關建議為前提。

2.2客戶明白並自願承擔接受營養及健康諮詢服務的固有風險,包括但不限於嘗試新食物、改變飲食習慣及生活方式等。

2.3就客戶因接受本公司服務而引致的任何索賠或法律責任,客戶在此釋除本公司人員及 Nutrition Point Ltd 的一切法律責任,惟以下情況除外:由本公司人員的嚴重疏忽(gross negligence)直接導致的損害;本公司根據香港適用法律不得限制或排除的任何責任(包括但不限於人身傷亡)。

2.4本免責聲明受香港《管制豁免條款條例》(第71章)及《不合情理合約條例》(第458章)規管。本公司不試圖排除法例強制規定的最低消費者保障。


第三條保密及個人資料保護

3.1本公司人員對客戶所有個人及健康資料嚴格保密。除法律強制披露、客戶明確書面同意、或為保護客戶或第三者生命安全所必需外,本公司不會在未獲客戶同意下向任何第三方披露客戶資料。

3.2本公司根據香港《個人資料(私隱)條例》(第486章)收集、持有、處理及使用客戶個人資料。

3.3客戶有權根據私隱條例查閱及更正其個人資料。如有查詢,請聯絡本公司資料保護主任。

3.4本公司將採取切實可行的步驟,保護客戶個人資料免遭未經授權的存取、披露或使用。


第四條付款、退款及產品退回
(甲)付款

4.1客戶須於接受服務時即時繳付費用予 Nutrition Point Ltd。

(乙)服務費用退款

4.2服務費用(不包括產品)不設退款,惟在以下情況下本公司可酌情考慮:本公司人員因本公司原因取消預約且未能重新安排;服務因本公司造成的失誤而未能提供。

(丙)貨品問題及退換

4.3如客戶收貨後發現產品質量問題、產品不符合訂單(錯誤貨品)或訂單貨品缺漏,須於收貨起計 3 個工作天內通知本公司。

4.4如屬本公司責任(包括以上 4.3 所列情況),本公司將安排順豐快遞免費上門收取及重新發送相關貨品,客戶無需承擔任何運費。

4.5如屬客戶人為錯誤(例如填錯地址、拒絕收貨等),退換所產生的運費及相關費用由客戶自行承擔。

4.6逾期通知(超過 3 個工作天)的退換申請,本公司保留酌情處理的權利。

(丁)產品退款條件

4.7只接受符合以下所有條件的退款申請:產品未開封,包裝完整,處於可再訂價及良好銷售狀態;產品距到期日尚有不少於五(5)個月的保質期;退款申請須於購買日起計 7 個曆日內提出。

4.8獲批退款將扣除港幣五十元(HKD $50)行政手續費。退款將以原付款方式退回,處理時間約為 5 至 10 個工作天。

4.9距退貨日起計五(5)個月內到期的產品不符合退款資格。

(戊)註冊營養師/營養師簽署收據及索償表格

4.10客戶如要求本公司註冊營養師或營養師簽署收據或索償表格(claim form),僅適用於初診收費為港幣八百八十元(HKD $880)或以上的預約。如客戶之初診收費已達港幣八百八十元(HKD $880)或以上,其後所有覆診預約(即使覆診收費低於港幣八百八十元)同樣合資格。如初診收費低於港幣八百八十元(HKD $880),則一律不合資格。

4.11如初診收費低於港幣八百八十元(HKD $880),客戶一律須先補足差額至港幣八百八十元(HKD $880),方可要求本公司註冊營養師或營養師簽署收據或索償表格。

4.12本公司註冊營養師或營養師簽署收據或索償表格,並不保證客戶能成功向其保險公司、醫療保健計劃或任何第三方索償機構獲得賠償或退款。賠償之批核與否,概由相關保險公司或索償機構自行決定,本公司不承擔任何責任。

4.13每一節預約,本公司營養師只會簽發一張屬於當日的收據或索償表格。

4.14如客戶要求將收據或索償表格拆分為多於一張(例如將補充品與營養師覆診費用分開列明),在合法及合理的前提下,本公司會盡力配合拆分。惟每節預約只免費簽發一張收據或索償表格;第二張或以上的單據,每張須另加港幣一百元(HKD $100)行政手續費。

4.15如客戶於完成預約並離開本公司中心後,方要求補發收據或索償表格,本公司有權就每張收據或索償表格收取港幣五十至一百元(HKD $50–$100)行政手續費。免費簽發收據或索償表格,僅適用於客戶於當場(即預約當日、客戶仍在中心內時)已通知營養師之情況;如客戶於離開中心後方通知,一律不獲免費處理。


第五條預約更改、取消及缺席政策
「缺席預約」(No-Show)定義

凡屬以下情況,均視為「缺席預約」:(i)客戶未有按時出席已確認預約而未提前通知本公司;(ii)客戶於預約開始前 3 小時內提出取消或更改;(iii)客戶於預約開始後 10 分鐘仍未到達本公司,或於此時提出取消/更改。

(甲)缺席預約收費時間表

5.1上述費用將直接從客戶預繳費用或下次預約費用中扣除;若客戶未有預繳金額,本公司將向客戶發出繳費通知,客戶須於收到通知後 7 個曆日內繳清。

(乙)緊急豁免

5.2如客戶因以下緊急情況而未能履行上述通知要求,上述收費條款可予豁免,惟客戶須於情況許可後盡快通知本公司,並於要求時提供相關證明文件:客戶本人或直系家屬突發嚴重疾病或意外;自然災害或政府宣佈緊急情況;其他本公司認為屬合理的緊急情況。

(丙)加急更改手續費

5.3如需於 14 個曆日內更改預約時間,本公司或會酌情收取額外行政費(HKD $380 至 HKD $880)。本公司將就個別情況通知客戶。

(丁)JIM LAU 專科預約更改規定

5.4就 JIM LAU 的預約更改申請,客戶須於提出更改或取消後 48 小時內完成重新預約,否則需重新輪候。

(戊)超前預約更改規定

5.5如客戶更改距當日超過 3 個月的預約,以下規定自 2023 年 7 月 1 日起適用:客戶須預付下次諮詢費用;或購買符合最新營養指引的至少 2 個月份量膳食補充劑。如屬第三次或以上更改,每次另加行政費 HKD $50。

5.6如本公司未能收到上述預付費用,相關預約將視為未確認,並可能於 48 小時後予以取消。

5.7指定時段附加費(公司可酌情豁免):1 個月內或指定時間 HKD $1,140;2 個月內 HKD $760。

豁免情況:客戶持有主診醫生出具的緊急證明文件,或屬本公司認可的緊急情況,以上附加費及行政費規定不適用。

(己)預繳服務細則

5.8以下情況客戶須在確認預約前預先繳付費用:首次預約或過去 90 天內無預約記錄的客戶;正在更改或重新預約因缺席(No-Show)或已取消的預約的客戶;本公司營養師按個別情況評估後要求預繳的客戶。

5.9如客戶不同意預繳或未能在指定時間內完成付款,本公司將取消相關預約。

5.10已預繳費用如因個人原因取消預約,退款事宜依照本須知第四條的退款政策處理。


第六條服務成效及保證條款

6.1本公司所提及的任何預期成效,均以客戶嚴格遵從本公司人員的營養建議及相關指示為前提,僅供參考。個人成效因體質、依從程度、生活習慣及其他因素而異。

6.2本公司任何計劃或療程均不附帶任何明示或暗示的效果保證。客戶參與本公司任何計劃,即確認已明白並同意以上條款。

6.3顧客確認並同意,Nutrition Point 所提供的營養諮詢、身體成分分析、膽固醇及其他健康評估或儀器測量,僅供一般營養教育、健康管理及趨勢參考,並不構成亦不可取代由註冊醫生提供的疾病診斷、醫療意見、化驗、影像檢查或治療;有關測量結果可因儀器型號、測量方法、時間、飲食、飲水、運動、生理狀況及其他因素而有所差異,Nutrition Point 不保證不同日期或不同機構的結果完全一致,顧客不應僅依賴有關結果決定是否進行驗血、CT 或其他醫療檢查、開始或停止任何治療,亦不應因此延誤求醫;如顧客對症狀、檢查結果、心血管風險或是否需要接受任何醫療檢查有疑問,應立即諮詢註冊醫生。


第七條Virtual Gym Unique 服務須知

7.1客戶確認已了解,心臟起搏器及懷孕為 Virtual Gym Unique 療程的主要禁忌症。Virtual Gym Unique 可能透過排毒過程協助改善若干健康狀況,惟療程只能由專業人員在具備客戶相關病歷及知識的情況下提供。若干健康狀況需要客戶簽署同意書,並遵從第 7.2 條的相關指示。

(甲)禁忌症清單

客戶確認其健康狀況並不包括以下情況。如客戶患有以下任何狀況,須先諮詢並獲得主診醫生批准,方可接受 Virtual Gym Unique 療程:

  • 癌症或任何惡性腫瘤病史
  • 正在接受放射治療(電療)或化療
  • 計劃或正在懷孕、餵哺母乳、剖腹產後或自然分娩後半年以內
  • 多系統疾病(例如糖尿病/高血壓/心臟病/肝病/腎病/甲狀腺疾病/免疫系統疾病等)
  • 血管或血液疾病(例如血栓性靜脈炎/凝血病/血管異常等)
  • 不受控制的出血或服用薄血藥
  • 淋巴疾病(例如淋巴管炎/淋巴異常腫脹或壓痛/淋巴瘤等)
  • 循環不良
  • 血脂過高
  • 中樞神經系統疾病
  • 急性發炎
  • 肝炎
  • 小腸氣
  • 膠原蛋白疾病(如硬皮症等)
  • 人類免疫力缺乏病毒(HIV)感染呈陽性
  • 生殖器官疾病
  • Virtual Gym 範圍出現未能解釋的身體疼痛
  • 皮膚病(如天皰瘡/皮膚過敏/多發性硬化/濕疹/蕁麻疹/牛皮癬/白癜風/疣/炎症/皰疹/大皰/酒渣鼻/系統性紅斑狼瘡/皮膚感染等)
  • Virtual Gym 範圍出現感染、傷口、損傷、腫脹、紅斑或任何敏感症狀
  • 正接受類固醇或荷爾蒙療程
  • 服用抗凝血劑或抗血小板藥物(例如 Coumadin® 等)
  • 身上帶有植入式起搏器/自動體外除顫器/自動除顫器/心臟復律器(除顫器)
  • 身上帶有金屬植入物或義肢
  • 配戴子宮環
  • 身上帶有整形部件
  • 近半年在療程範圍上方或周圍接受過手術(視乎手術部位及療程範圍而定)
  • 曾接觸高脂溶性化合物(例如 Kybella(去氧膽酸))
(乙)療程前後護理指示

療程前注意事項:

  • 前 1 日切勿飲酒
  • 前 2 至 3 天不可用磨沙擦洗 Virtual Gym 部位
  • 前 2 週不得曝曬/照射太陽燈/進行其他紫外線輻射照射
  • Virtual Gym 範圍於療程前至少 4 週並無進行化學換膚、強脈衝光、激光、射頻、微針等療程
  • 長期服用治療性藥物者,如需停藥進行療程,須先取得主診醫生書面醫療證明及批准

療程後建議:

  • 後 2 至 3 日,每日至少飲用 8 至 10 杯水,建議加入鮮檸檬汁
  • 早餐進食檸檬或西柚
  • 每日至少進食 2 個蘋果
  • 多菜少肉,減少攝取脂肪及碳水化合物(例如米飯、麵條及糖)
  • 切勿飲酒
  • 維持良好運動習慣
(丙)療程後可能出現的反應

以下反應屬正常現象,客戶無需過慮:

  • 軟墊接觸位置周圍出現紅印(一般於數小時內消退)
  • 輕微的肌肉酸痛(一般於數日內消退)
  • 24 小時內感到口渴

於排毒週期中,部分客戶或會出現以下症狀,在情況好轉前甚至可能短暫加劇,一般於 3 至 4 日內消退:

  • 腹瀉
  • 尿頻
  • 尿液帶異常氣味
  • 類似流感症狀,包括頭痛
  • 身體疼痛
  • 疲倦/疲勞(可能持續一週以上)
  • 飢餓感加劇(可能持續一週以上)
  • 噁心或胃痛
  • 皮疹(通常一週內消失)
(丁)療程前客戶確認事項

客戶在接受 Virtual Gym Unique 療程前,確認並承諾以下各點:

  • 如客戶的健康狀況有變或感到不適,將於療程前主動通知治療師
  • 如客戶在 Virtual Gym 進行期間正服用任何藥物,將先與治療師核實是否仍適合繼續療程
  • Virtual Gym 可能產生不適感或肌肉抽搐感覺,通常持續數分鐘;如刺激感過強,客戶將主動通知治療師
(戊)VGU 預約更改及缺席政策

7.2預約更改(24 小時前):若顧客未能如期赴約,並於預約開始前 24 小時或以上提出更改,本中心將盡量安排於最近可行的日子為顧客重新預約。

7.3預約更改(8 小時內):若顧客於預約開始前 8 小時內方提出更改或取消,有關預約將視作「已完成」,並計算為已使用之套餐次數,本中心不設補回安排。

7.4特殊情況豁免:如顧客因以下突發情況而未能提前更改,本中心將按個別情況另行處理:突發意外或緊急事故;月經(無需醫生證明);突發疾病(須提供註冊醫生出具之醫生證明)。

7.5當天遲到政策:

  • 若顧客於當天預約遲到逾 10 分鐘,本中心未必能提供完整療程服務,療程時間將按實際情況縮短,惟仍計算為已使用之套餐次數。
  • 若顧客遲到逾 15 分鐘,本中心有權將該次預約視為 No-Show 並當作「已完成」,計算為已使用之套餐次數,不設補回安排。

7.6地點調動:Virtual Gym 療程地點可能因應本公司人員之安排而有所調動。如有地點變更,本中心將提前透過 WhatsApp 通知顧客。

營業時間外申請處理

如顧客於本中心營業時間以外提交任何預約更改申請,有關申請將視作於下一個工作日營業時間開始時提交及收悉,相關 8 小時/24 小時之計算期限亦由該時間起計算。本中心工作日及營業時間以官方網站最新公布為準。

(己)VGU 顧客產品折扣政策

7.7基本折扣資格:Virtual Gym Unique(下稱「VGU」)顧客在購買本公司指定產品時,可享有八五折(即定價 85%)折扣安排。以下產品不適用此折扣:本公司不定期指定之特定推廣產品;已享有其他推廣折扣之產品。

7.8活躍預約要求(Active Booking Requirement):顧客在購買產品當時,如其未來時間表中不存在任何已確認的 VGU 療程預約或 VGU 相關覆診預約(即「無活躍預約」狀態),則:(a)八五折折扣次數上限等於顧客 VGU 套餐剩餘次數(計算方法見 7.9);(b)超出次數上限後,一律回復至最基本折扣安排。

7.9折扣次數計算規則:在「無活躍預約」狀態下,可獲得之八五折次數上限按以下公式計算:

最大可用折扣次數 = VGU 套餐剩餘次數

7.10最基本折扣安排:「最基本折扣」指本公司對所有非 VGU 顧客於一般情況下提供的標準折扣安排。具體幅度以本公司當時公佈為準,並可能因產品而異。

7.11資格核實:本公司保留權利於購買時核實顧客的 VGU 預約狀態及套餐剩餘次數。如顧客所報稱的狀態與本公司記錄不符,本公司有權按實際情況調整折扣安排,並無需另行通知。


第八條送貨安排及運費
(甲)一般送貨安排

8.1送貨服務僅適用於香港本地地區。

8.2本公司使用指定運輸承辦商提供送貨服務。在一般情況下,使用本公司指定承辦商可享免運費安排(特別情況除外,詳見 8.13)。

8.3訂單成功處理後,本公司將透過 WhatsApp 向客戶發出確認訊息,當中包括預計派送方式及時間安排。

8.4本公司保留權利,在特定情況下選擇合適的送貨方式及收取相應費用,並事先通知客戶。

(乙)公平運送原則

8.5本公司提供有限度的免運費安排,以合理自用為前提。公司保留權利就個別訂單評估運送費用安排,並於有理由所需時向顧客收取運費。

8.6如下列情況出現,公司人員有權就訂單收取運費,包括但不限於:有合理理由懷疑顧客代他人購買(例如口供不符、收件人資訊不一致、大量重複訂單等);顧客以小量多次方式不斷送貨,謀取免運費安排(例如分批次下單但實際為同一訂單);不合理更改送貨地址,包括頻繁更改、收件人名稱不一致或收件資訊不合理;其他屬不合理使用安排的情況。

8.7本公司不會代為分開寄出訂單。所有訂單將一併打包寄出,本公司不處理小量多次分拆送貨的請求。

溫馨提醒

免運費安排以顧客合理自用為原則。如公司人員發現任何不合理使用情況,將會向顧客收取實際遞貨費用,並保留往後拒絕提供免運費服務的權利。

(丙)送貨時效

8.8一般訂單處理時間為 1 至 4 個工作天(星期一至六,公眾假期除外)。

8.9本公司逢星期日不設派送服務。

8.10實際送達時間視乎運輸承辦商的安排,本公司不對運輸承辦商造成的延誤承擔責任。

8.11如客戶需要特別安排收貨時間,請在下單前提前與本公司客服聯絡。

8.12如遇特殊情況(包括但不限於惡劣天氣、交通事故、公眾假期),送貨時間或有調整,本公司將盡量通知客戶。

(丁)需收取額外運費的地區

8.13以下地區因地理位置特殊,本公司指定承辦商或無法提供一般免運費服務,實際收費以承辦商報價為準:

(戊)特別運送安排

8.14順豐智能櫃:如客戶指定送貨至順豐智能櫃,相關運費由客戶自行承擔(特定推廣產品除外,推廣詳情以本公司公佈為準)。

8.15如遇特定情況本公司無法使用指定運輸承辦商,本公司將改用其他快遞方式發送,並提前通知客戶,相關費用由客戶承擔。

8.16如客戶要求使用特定送貨方式,本公司保留收取適當運費的權利,並會事先向客戶確認。

(己)門市自取安排

8.17自取服務僅在特定情況下提供,需事先向本公司確認。

8.18所有自取訂單須於自取前完成付款。

8.19貨品於訂單確認後保留 7 個曆日。逾期未取,本公司將安排以運輸方式發出,客戶或需承擔相應運費,本公司將事先通知。


第九條收費詳情表

第十條一般條款

10.1適用法律:本須知受香港特別行政區法律管轄,並依據香港法律詮釋。

10.2爭議解決:如因本須知引起任何爭議,雙方同意首先透過友好協商解決;如協商未能達成協議,雙方同意提交香港法院的專屬司法管轄解決。

10.3條款修訂:本公司保留隨時修訂本須知的權利。修訂版本將於本公司網站公佈,並以最新版本為準。客戶於修訂後繼續使用本公司服務,即視為接受修訂後的條款。

10.4條款可分割性:若本須知任何條款被裁定為無效、不可執行或違法,該條款將在最小可能範圍內修改或刪除,而不影響其餘條款的效力及可執行性。

10.5完整協議:本須知構成雙方就服務、運輸及退款事宜的完整協議,並取代所有先前的口頭或書面協議。

10.6語言:本須知以中文(繁體)為主要版本。如中英文版本有任何歧義,以中文(繁體)版本為準。

10.7營業時間外申請:任何關於服務的更改或其他相關申請,如於本中心營業時間以外提交,均視作於下一個工作日營業時間開始時提交及由本中心收悉,相關處理期限亦由該時間起計算。

10.8工作日及營業時間:本中心之工作日及營業時間,以本中心官方網站所公布之最新資料為準。公眾假期、中心休息日、臨時休業或因特殊情況而調整之營業時間,均不計算為工作日或正常營業時間,相關申請之處理期限將順延至下一個正常工作日計算。

IMPORTANT NOTICE

The Company's professional staff (including Registered Dietitians and Nutritionists/Dietary Health Consultants) provide nutritional therapy consultation and healthy dietary education, and do not engage in medical diagnosis or medical prescribing. The Company's services do not constitute any medical advice or medical care, nor can they replace any medical services provided by medical professionals (including doctors). If you have any illness or health concerns, please consult a registered medical practitioner.


Article IDisclaimer

1.1The Company's staff include Registered Dietitians holding recognised qualifications, as well as Nutritionists/Dietary Health Consultants. The professional qualifications and scope of service of different staff members may vary. The scope of the Company's services is: to provide personalised dietary and nutritional advice, to impart professional knowledge on food, dietary supplements and dietary habits, and to assist clients in understanding and improving their personal nutritional status.

1.2The Company's staff do not provide the following services, which are outside their scope of practice: medical diagnosis, medical prescriptions or medication advice, and any form of medical treatment.

1.3"Nutritional Therapy" / "Medical Nutrition Therapy" is an internationally recognised professional term for dietitians, referring to the support of overall health management from a nutritional science perspective through dietary and dietary supplement intervention. This term does not represent or imply that the Company provides any medical diagnosis or medical prescription service.

1.4If the client is currently receiving care from a healthcare professional or taking prescribed medication, the client should discuss with his/her attending doctor before changing dietary habits or commencing any dietary supplement. The client should not discontinue any prescribed medication without the approval of his/her attending doctor.

1.5The nutritional consultation services provided by the Company are independent of the services of medical institutions and do not constitute medical advice or care. The client should continue to receive regular medical supervision from his/her attending doctor.

1.6To the maximum extent permitted by the applicable laws of Hong Kong, the Company shall not be liable for any loss, damage or consequence arising from the client's own decision to adopt or not to adopt the Company's advice.


Article IIPersonal Responsibility and Limitation of Liability

2.1The client acknowledges that the client shall bear full personal responsibility for all lifestyle and health decisions made by the client, his/her family members and children (if applicable) during and after receipt of the Company's services. All anticipated outcomes of nutritional advice are premised on the client's full compliance with the relevant advice.

2.2The client understands and voluntarily assumes the inherent risks of receiving nutritional and health consultation services, including but not limited to trying new foods and changing dietary habits and lifestyles.

2.3In respect of any claim or legal liability arising from the client's receipt of the Company's services, the client hereby releases the Company's staff and Nutrition Point Ltd from all legal liability, save in the following circumstances: damage directly caused by the gross negligence of the Company's staff; any liability that the Company is not permitted to limit or exclude under the applicable laws of Hong Kong (including but not limited to personal injury or death).

2.4This disclaimer is governed by the Control of Exemption Clauses Ordinance (Cap. 71) and the Unconscionable Contracts Ordinance (Cap. 458) of Hong Kong. The Company does not seek to exclude the minimum consumer protection mandated by statute.


Article IIIConfidentiality and Personal Data Protection

3.1The Company's staff shall strictly keep all personal and health information of the client confidential. Save where disclosure is required by law, where the client has given express written consent, or where necessary to protect the life or safety of the client or any third party, the Company shall not disclose the client's information to any third party without the client's consent.

3.2The Company collects, holds, processes and uses the client's personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

3.3The client has the right to access and correct his/her personal data in accordance with the Privacy Ordinance. For enquiries, please contact the Company's Data Protection Officer.

3.4The Company shall take all practicable steps to protect the client's personal data against unauthorised access, disclosure or use.


Article IVPayment, Refund and Product Return
(A) Payment

4.1The client shall pay the fees to Nutrition Point Ltd immediately upon receipt of the service.

(B) Service Fee Refund

4.2Service fees (excluding products) are non-refundable, save that the Company may, at its discretion, consider a refund in the following circumstances: the Company's staff cancels the appointment due to the Company's reasons and is unable to reschedule; the service cannot be provided due to an error caused by the Company.

(C) Product Issues and Exchange

4.3If the client discovers a product quality issue, a product that does not match the order (wrong goods), or a missing item after receiving the goods, the client shall notify the Company within 3 working days from the date of receipt.

4.4Where the matter is the Company's responsibility (including the circumstances listed in clause 4.3 above), the Company shall arrange for SF Express to collect and re-deliver the relevant goods free of charge, and the client shall not bear any shipping fee.

4.5Where the matter is caused by the client's error (e.g. wrong address entered, refusal to receive goods, etc.), the shipping fees and related costs incurred for the exchange shall be borne by the client.

4.6For exchange applications notified after the deadline (beyond 3 working days), the Company reserves the right to handle the same at its discretion.

(D) Conditions for Product Refund

4.7Only refund applications meeting all of the following conditions will be accepted: the product is unopened, with intact packaging, in a resaleable and good saleable condition; the product has a shelf life of not less than five (5) months remaining before the expiry date; the refund application must be made within 7 calendar days from the date of purchase.

4.8Approved refunds will be subject to a deduction of a Hong Kong Dollars Fifty (HKD $50) administrative handling fee. The refund will be returned via the original payment method, with a processing time of approximately 5 to 10 working days.

4.9Products with less than five (5) months remaining before the expiry date from the date of return do not qualify for a refund.

(E) Dietitian-signed Receipts and Claim Forms

4.10Where the client requests the Company's Registered Dietitian or Nutritionist to sign a receipt or claim form, the same shall only apply to initial consultations with a fee of Hong Kong Dollars Eight Hundred and Eighty (HKD $880) or above. Where the client's initial consultation fee has reached HKD $880 or above, all subsequent follow-up consultations (even if the follow-up fee is below HKD $880) shall likewise be eligible. Where the initial consultation fee is below HKD $880, the same shall not be eligible in any circumstances.

4.11Where the initial consultation fee is below Hong Kong Dollars Eight Hundred and Eighty (HKD $880), the client shall first pay the difference to make up the fee to Hong Kong Dollars Eight Hundred and Eighty (HKD $880) before requesting the Company's Registered Dietitian or Nutritionist to sign a receipt or claim form.

4.12The signing of a receipt or claim form by the Company's Registered Dietitian or Nutritionist does not guarantee that the client will successfully obtain compensation or refund from his/her insurance company, healthcare scheme or any third-party claims organisation. The approval of any claim shall be determined solely by the relevant insurance company or claims organisation, and the Company shall not bear any liability in respect thereof.

4.13For each appointment, the Company's dietitian shall issue only one receipt or claim form dated on the day of the appointment.

4.14Where the client requests the receipt or claim form to be split into more than one (for example, separating supplement charges from the dietitian's consultation fee), the Company shall, subject to legality and reasonableness, endeavour to accommodate such request for splitting. However, only one receipt or claim form per appointment shall be issued free of charge; the second and each subsequent receipt shall be subject to an additional administrative handling fee of Hong Kong Dollars One Hundred (HKD $100) per receipt.

4.15Where the client requests the issuance of a receipt or claim form after completing the appointment and having left the Company's centre, the Company reserves the right to charge an administrative handling fee of Hong Kong Dollars Fifty to One Hundred (HKD $50–$100) per receipt or claim form. Free issuance of a receipt or claim form shall only apply where the client has notified the dietitian on the spot (i.e., on the day of the appointment while the client is still at the centre); where the client notifies the Company after leaving the centre, no free service shall be provided.


Article VAppointment Rescheduling, Cancellation and No-Show Policy
Definition of "No-Show"

The following circumstances shall all be regarded as a "No-Show": (i) the client fails to attend a confirmed appointment on time without notifying the Company in advance; (ii) the client proposes cancellation or rescheduling within 3 hours before the appointment; (iii) the client has still not arrived at the Company 10 minutes after the appointment commences, or proposes cancellation/rescheduling at that time.

(A) No-Show Fee Schedule

5.1The above fees will be deducted directly from the client's prepaid fees or the next appointment fee; if the client has no prepaid amount, the Company will issue a payment notice to the client, and the client shall settle the same within 7 calendar days from receipt of the notice.

(B) Emergency Waiver

5.2If the client is unable to comply with the above notification requirements due to the following emergency circumstances, the above fee provisions may be waived, provided that the client notifies the Company as soon as practicable after the circumstances permit, and provides supporting documents upon request: sudden serious illness or accident of the client or his/her immediate family member; natural disaster or government-declared emergency; any other circumstance that the Company considers to be a reasonable emergency.

(C) Expedited Rescheduling Handling Fee

5.3If rescheduling of an appointment within 14 calendar days is required, the Company may, at its discretion, charge an additional administrative fee (HKD $380 to HKD $880). The Company will notify the client on a case-by-case basis.

(D) JIM LAU Specialist Appointment Rescheduling

5.4In respect of rescheduling applications for JIM LAU appointments, the client shall complete the re-booking within 48 hours after submitting the rescheduling or cancellation request, failing which the client shall queue again.

(E) Advance Appointment Rescheduling

5.5Where the client reschedules an appointment more than 3 months from the current date, the following provisions shall apply from 1 July 2023: the client shall prepay the next consultation fee; or purchase at least 2 months' supply of dietary supplements meeting the latest nutritional guidelines. If it is the third or subsequent rescheduling, an administrative fee of HKD $50 shall be added for each rescheduling.

5.6If the Company does not receive the above prepayment, the relevant appointment shall be deemed unconfirmed and may be cancelled after 48 hours.

5.7Designated time-slot surcharge (the Company may waive at its discretion): within 1 month or designated time HKD $1,140; within 2 months HKD $760.

Waiver circumstances: Where the client holds an emergency certificate issued by the attending doctor, or where it is a Company-recognised emergency, the above surcharge and administrative fee provisions shall not apply.

(F) Prepayment Service Terms

5.8The client shall prepay the fee before confirming the appointment in the following circumstances: clients on their first appointment or with no appointment record in the past 90 days; clients who are rescheduling or re-booking an appointment that was a No-Show or was cancelled; clients whom the Company's dietitian, upon individual assessment, requires to prepay.

5.9If the client does not agree to prepay or fails to complete payment within the specified time, the Company will cancel the relevant appointment.

5.10Where a prepaid fee is cancelled due to personal reasons, the refund matter shall be handled in accordance with the refund policy in Article IV of this Notice.


Article VIService Efficacy and Guarantee

6.1Any anticipated outcomes referred to by the Company are premised on the client's strict compliance with the nutritional advice and relevant instructions of the Company's staff, and are for reference only. Individual outcomes vary depending on constitution, level of compliance, lifestyle and other factors.

6.2The Company's plans or treatment courses do not carry any express or implied guarantee of outcome. The client's participation in any of the Company's plans constitutes an acknowledgement that the client has understood and agrees to the above terms.

6.3The client acknowledges and agrees that the nutritional consultation, body composition analysis, cholesterol and other health assessments or instrument measurements provided by Nutrition Point are for general nutritional education, health management and trend reference only, and do not constitute, nor can they replace, disease diagnosis, medical advice, laboratory tests, imaging examinations or treatment provided by a registered medical practitioner; the measurement results may vary due to instrument model, measurement method, time, diet, water intake, exercise, physiological condition and other factors, and Nutrition Point does not guarantee that results from different dates or different institutions will be completely consistent; the client should not rely solely on such results to decide whether to undergo blood tests, CT or other medical examinations, or to commence or discontinue any treatment, nor should the client delay seeking medical attention on account thereof; if the client has any questions about symptoms, examination results, cardiovascular risk, or the need for any medical examination, the client should consult a registered medical practitioner immediately.


Article VIIVirtual Gym Unique Service Notice

7.1The client acknowledges that he/she has understood that cardiac pacemakers and pregnancy are the principal contraindications for the Virtual Gym Unique treatment. Virtual Gym Unique may, through the detoxification process, assist in improving certain health conditions, provided that the treatment may only be provided by professional staff in possession of the client's relevant medical history and knowledge. Certain health conditions require the client to sign a consent form and to comply with the relevant instructions in clause 7.2.

(A) Contraindication List

The client confirms that his/her health condition does not include the following. If the client suffers from any of the following conditions, he/she must first consult and obtain the approval of his/her attending doctor before receiving the Virtual Gym Unique treatment:

  • History of cancer or any malignant tumour
  • Currently undergoing radiotherapy or chemotherapy
  • Planning or currently pregnant, breastfeeding, within six months after caesarean section or natural delivery
  • Multi-system diseases (e.g. diabetes/hypertension/heart disease/liver disease/kidney disease/thyroid disease/immune system disease, etc.)
  • Vascular or blood diseases (e.g. thrombophlebitis/coagulopathy/vascular abnormalities, etc.)
  • Uncontrolled bleeding or use of anticoagulant medication
  • Lymphatic diseases (e.g. lymphangitis/abnormal lymphatic swelling or tenderness/lymphoma, etc.)
  • Poor circulation
  • Hyperlipidaemia
  • Central nervous system diseases
  • Acute inflammation
  • Hepatitis
  • Hernia
  • Collagen diseases (e.g. scleroderma, etc.)
  • HIV-positive
  • Reproductive organ diseases
  • Unexplained bodily pain in the Virtual Gym area
  • Skin diseases (e.g. pemphigus/skin allergy/multiple sclerosis/eczema/urticaria/psoriasis/vitiligo/warts/inflammation/herpes/bullae/rosacea/systemic lupus erythematosus/skin infection, etc.)
  • Infection, wounds, injury, swelling, erythema or any allergic symptoms in the Virtual Gym area
  • Currently receiving steroid or hormonal therapy
  • Taking anticoagulants or antiplatelet medication (e.g. Coumadin®, etc.)
  • Carrying an implanted pacemaker/automated external defibrillator/automatic defibrillator/cardioverter-defibrillator
  • Carrying metal implants or prosthetics
  • Wearing an intrauterine device
  • Carrying prosthetic components
  • Surgery in or around the treatment area within the last six months (depending on the surgical site and treatment area)
  • Prior exposure to highly liposoluble compounds (e.g. Kybella (deoxycholic acid))
(B) Pre- and Post-Treatment Care Instructions

Pre-treatment precautions:

  • No alcohol on the day before
  • Do not scrub the Virtual Gym area with exfoliants for 2 to 3 days before
  • No sun exposure/sunbed/other UV radiation for 2 weeks before
  • No chemical peel, intense pulsed light, laser, radiofrequency, microneedling, etc. in the Virtual Gym area for at least 4 weeks before
  • Those on long-term therapeutic medication, if medication needs to be suspended for the treatment, must first obtain written medical certification and approval from the attending doctor

Post-treatment recommendations:

  • For 2 to 3 days after, drink at least 8 to 10 glasses of water daily, with fresh lemon juice recommended
  • Have lemon or grapefruit for breakfast
  • Eat at least 2 apples daily
  • More vegetables, less meat; reduce intake of fats and carbohydrates (e.g. rice, noodles and sugar)
  • No alcohol
  • Maintain good exercise habits
(C) Possible Reactions After Treatment

The following reactions are normal and the client need not be concerned:

  • Red marks around the pad contact area (usually subside within hours)
  • Mild muscle soreness (usually subsides within days)
  • Thirst within 24 hours

During the detoxification cycle, some clients may experience the following symptoms, which may even temporarily worsen before improving, usually subsiding within 3 to 4 days:

  • Diarrhoea
  • Frequent urination
  • Abnormal-smelling urine
  • Flu-like symptoms, including headache
  • Bodily pain
  • Tiredness/fatigue (may last for more than a week)
  • Increased hunger (may last for more than a week)
  • Nausea or stomach pain
  • Skin rash (usually disappears within a week)
(D) Client Confirmation Items Before Treatment

The client, before receiving the Virtual Gym Unique treatment, confirms and undertakes the following:

  • If the client's health condition changes or he/she feels unwell, he/she will proactively notify the therapist before the treatment
  • If the client is taking any medication during the Virtual Gym session, he/she will first verify with the therapist whether it remains suitable to continue the treatment
  • Virtual Gym may produce discomfort or muscle twitching sensations, usually lasting for several minutes; if the stimulation is too strong, the client will proactively notify the therapist
(E) VGU Appointment Rescheduling and No-Show Policy

7.2Rescheduling (24 hours before): If the client is unable to attend as scheduled and proposes rescheduling at 24 hours or more before the appointment commences, the Centre will endeavour to arrange a re-booking on the nearest feasible date.

7.3Rescheduling (within 8 hours): If the client proposes rescheduling or cancellation within 8 hours before the appointment commences, the relevant appointment shall be deemed "completed" and counted as a used package session, and the Centre does not provide any make-up arrangement.

7.4Special circumstance waiver: If the client is unable to give advance notice of rescheduling due to the following unforeseen circumstances, the Centre will handle the matter separately on a case-by-case basis: sudden accident or emergency; menstruation (no doctor's certificate required); sudden illness (a doctor's certificate issued by a registered medical practitioner must be provided).

7.5Same-day lateness policy:

  • If the client is more than 10 minutes late for the same-day appointment, the Centre may not be able to provide the full treatment service, and the treatment time will be shortened according to actual circumstances, but it will still be counted as a used package session.
  • If the client is more than 15 minutes late, the Centre reserves the right to treat the appointment as a No-Show and as "completed", counted as a used package session, with no make-up arrangement.

7.6Venue reassignment: The Virtual Gym treatment venue may be adjusted according to the Company's staff arrangements. In the event of a venue change, the Centre will notify the client in advance via WhatsApp.

Handling of Out-of-Hours Applications

If the client submits any appointment rescheduling application outside the Centre's business hours, the relevant application shall be deemed to have been submitted and received at the commencement of business hours on the next working day, and the relevant 8-hour/24-hour calculation period shall also be counted from that time. The Centre's working days and business hours are subject to the latest announcement on the official website.

(F) VGU Customer Product Discount Policy

7.7Basic discount eligibility: Virtual Gym Unique ("VGU") customers, when purchasing the Company's designated products, may enjoy a 15% discount (i.e. 85% of the list price). The following products are not eligible for this discount: specific promotional products designated by the Company from time to time; products already subject to other promotional discounts.

7.8Active Booking Requirement: At the time of product purchase, if the customer does not have any confirmed VGU treatment appointment or VGU-related follow-up appointment in his/her future schedule (i.e. an "inactive booking" status), then: (a) the maximum number of 15% discount applications equals the number of remaining sessions in the customer's VGU package (calculation method see clause 7.9); (b) after exceeding the maximum number, the discount shall revert to the most basic discount arrangement.

7.9Discount frequency calculation rule: Under the "inactive booking" status, the maximum number of 15% discount applications is calculated according to the following formula:

Maximum Available Discount Count = VGU Package Remaining Sessions

7.10Most basic discount arrangement: "Most basic discount" refers to the standard discount arrangement that the Company provides to all non-VGU customers under general circumstances. The specific rate is subject to the Company's announcement at the time and may vary by product.

7.11Eligibility verification: The Company reserves the right to verify the customer's VGU appointment status and package remaining sessions at the time of purchase. If the status reported by the customer does not match the Company's records, the Company has the right to adjust the discount arrangement according to the actual circumstances, without further notice.


Article VIIIDelivery Arrangements and Shipping Fees
(A) General Delivery Arrangements

8.1Delivery service is applicable to local Hong Kong areas only.

8.2The Company uses designated carriers to provide delivery service. Under normal circumstances, free shipping is available when using the Company's designated carrier (except in special circumstances, see clause 8.13).

8.3After the order is successfully processed, the Company will send a confirmation message to the client via WhatsApp, including the estimated delivery method and time arrangement.

8.4The Company reserves the right, under specific circumstances, to select a suitable delivery method and charge the corresponding fee, and to notify the client in advance.

(B) Fair Shipping Principle

8.5The Company provides a limited free shipping arrangement, premised on reasonable personal use. The Company reserves the right to assess the shipping fee arrangement for individual orders, and to charge the customer a shipping fee where there is reason to do so.

8.6If the following circumstances arise, the Company's staff have the right to charge a shipping fee for the order, including but not limited to: there is reasonable cause to suspect the customer is purchasing on behalf of others (e.g. inconsistent statements, inconsistent recipient information, large numbers of duplicate orders, etc.); the customer repeatedly places deliveries in small, multiple batches to obtain free shipping (e.g. split orders that are in fact the same order); unreasonable changes to the delivery address, including frequent changes, inconsistent recipient names or unreasonable recipient information; other circumstances constituting unreasonable use.

8.7The Company will not split and dispatch orders on the customer's behalf. All orders will be packed and dispatched together, and the Company does not process requests for split deliveries in small, multiple batches.

Warm Reminder

The free shipping arrangement is premised on the customer's reasonable personal use. If the Company's staff identify any unreasonable use, the actual delivery fee will be charged to the customer, and the Company reserves the right to refuse to provide free shipping service in future.

(C) Delivery Timeframe

8.8The general order processing time is 1 to 4 working days (Monday to Saturday, excluding public holidays).

8.9The Company does not provide delivery service on Sundays.

8.10The actual delivery time is subject to the carrier's arrangements, and the Company shall not be liable for delays caused by the carrier.

8.11If the client requires a special delivery time arrangement, please contact the Company's customer service in advance before placing the order.

8.12In the event of special circumstances (including but not limited to inclement weather, traffic accidents, public holidays), the delivery time may be adjusted, and the Company will notify the client as far as possible.

(D) Regions Requiring Additional Shipping Fees

8.13The following regions, due to their special geographical location, may not be eligible for the general free shipping service from the Company's designated carrier, and the actual charge is subject to the carrier's quotation:

(E) Special Delivery Arrangements

8.14SF Locker: If the client designates delivery to an SF Locker, the relevant shipping fee shall be borne by the client (except for specific promotional products; promotional details are subject to the Company's announcement).

8.15If, under specific circumstances, the Company is unable to use the designated carrier, the Company will dispatch via another courier method and notify the client in advance, and the relevant cost shall be borne by the client.

8.16If the client requests a specific delivery method, the Company reserves the right to charge an appropriate shipping fee, and will confirm with the client in advance.

(F) Store Self-Pickup Arrangement

8.17Self-pickup service is only provided under specific circumstances, and prior confirmation with the Company is required.

8.18All self-pickup orders must be paid in full before pickup.

8.19Goods will be retained for 7 calendar days after order confirmation. If not collected within the time limit, the Company will arrange to dispatch the goods by delivery, and the client may be required to bear the corresponding shipping fee, of which the Company will notify in advance.

Article XGeneral Terms

10.1Governing law: This Notice shall be governed by the laws of the Hong Kong Special Administrative Region and construed in accordance with Hong Kong law.

10.2Dispute resolution: If any dispute arises out of this Notice, both parties agree to first resolve it through amicable consultation; if consultation fails to reach agreement, both parties agree to submit to the exclusive jurisdiction of the Hong Kong courts.

10.3Amendment of terms: The Company reserves the right to amend this Notice at any time. The amended version will be published on the Company's website, and the latest version shall prevail. The client's continued use of the Company's services after the amendment constitutes acceptance of the amended terms.

10.4Severability: If any provision of this Notice is held to be invalid, unenforceable or illegal, such provision shall be modified or deleted to the minimum extent possible, without affecting the validity and enforceability of the remaining provisions.

10.5Entire agreement: This Notice constitutes the entire agreement between the parties regarding service, shipping and refund matters, and supersedes all prior oral or written agreements.

10.6Language: This Notice is issued in Chinese (Traditional) as the primary version. In the event of any discrepancy between the Chinese and English versions, the Chinese (Traditional) version shall prevail.

10.7Out-of-hours application: Any application regarding a change of service or other related matters, if submitted outside the Centre's business hours, shall be deemed to have been submitted and received by the Centre at the commencement of business hours on the next working day, and the relevant processing period shall also be counted from that time.

10.8Working days and business hours: The Centre's working days and business hours are subject to the latest information published on the Centre's official website. Public holidays, Centre rest days, temporary closures, or adjusted business hours due to special circumstances shall not count as working days or normal business hours, and the processing period for relevant applications will be extended to the next normal working day.
